Your Conviction Could Be Overturned. Call Us Today To Find Out How.

The appellate process is far different from the trial or plea negotiation stage of a criminal case. Unlike at trial, appeals focus on finding and correcting errors at trial or pretrial proceedings — specifically, whether the prosecutor, judge or defense attorney made a mistake. The success or failure of an appeal often hinges on the strength of legal arguments and effective writing and argument before the appellate court.

An appellate attorney must be able to convince a panel of judges, rather than a jury, that a mistake was made at trial or sentencing. Successfully handling criminal appeals thus requires superb legal reasoning, analysis and writing skills. In-depth knowledge of the law and innovative, critical thinking are also indispensable.

Extensive Experience · State And Federal Appeals

At the law firm of Hale & Blau, Attorneys at Law, PC, our attorneys have extensive experience handling criminal appeals before the North Carolina Court of Appeals, the North Carolina Supreme Court and the U.S. Court of Appeals for the 4th Circuit. We have also prepared numerous petitions for writs of certiorari before the United States Supreme Court.

Given this breadth of experience, we understand not only how to successfully pursue appeals, but also how to effectively prepare cases for appeal at the earliest possible step in the process before trial even begins. Our appellate practice informs and improves our ability to protect our clients' rights throughout the criminal process.

Our attorneys have more than 35 years of collective experience. We have handled more than 50 appeals, including many that resulted in major reversals and precedent-setting published opinions.

The foundation for a successful appeal must often be laid at or before trial. Our attorneys understand how to preserve appellate issues during the pretrial and trial stages. We also serve as consultants for trial attorneys, advising them of potential issues for appeal and ensuring that the appropriate objections are made to preserve those issues for appellate review.

Our attorneys have achieved victories in a number of significant appellate cases. For example:

  • We vacated the conviction and 30-month jail sentence of a client convicted of possession of a firearm by a felon, a federal offense.
  • We reversed the convictions of forgery and attempted fraud for a client who had been facing a 6- to 8-year jail sentence.
  • We vacated an order requiring our client to enroll in GPS monitoring for the rest of his life.
  • We obtained a new trial on all charges for a client convicted of multiple sex crimes who was facing a sentence of 25 to 30 years in jail.
  • We obtained a new sentencing hearing for a client who pled guilty to various federal drug charges and received a lengthy jail sentence.

We understand the conviction appeals process inside and out. Our attorneys have experience not only writing compelling appellate briefs, but also appearing in person before state and federal appellate courts to make strong legal arguments.
